Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.)

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day:

  • on which you or a third party named by you, who is not the carrier, took possession of the goods, provided you ordered one or more goods in a single order and they are delivered in a single shipment;

  • on which you or a third party named by you, who is not the carrier, took possession of the last good, provided you ordered several goods in a single order and they are delivered separately.

To exercise your right of withdrawal, you must inform us (FLEXILOW® / Brandsetter Agency / co.Regus Neumarktgalerie, Richmondstr, 6, 50667 Cologne, Germany) of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery we offer), without undue delay and at the latest within 14 days from the day on which we received notice of your withdrawal. We will carry out the refund using the same payment method that you used for the initial transaction unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

We may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any event not later than 14 days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the 14-day period has expired.

You will bear the direct costs of returning goods that can be sent as a parcel, as well as the direct costs of returning non-parcel-shippable goods. The cost of returning non-parcel-shippable goods is estimated to be up to a maximum of approximately 500 EUR.

You are only liable for any diminished value of the goods if the diminished value results from handling the goods beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusions or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

  • for the supply of goods that are not prefabricated and for which an individual selection or decision by the consumer is essential, or which are clearly tailored to the consumer's personal needs;
  • for the supply of goods that can spoil quickly or whose expiration date would soon be exceeded;
  • for the supply of alcoholic beverages whose price was agreed upon at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on market fluctuations beyond the trader’s control;
  • for the supply of newspapers, periodicals, or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts:

  • for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery;
  • for the supply of goods that, after delivery, are inseparably mixed with other items due to their nature;
  • for the supply of audio or video recordings or computer software in a sealed package, if the seal was removed after delivery.
